What is the name of your state (only U.S. law)? Michigain

OK, simple question. If a family member were assaulted as part of a routine traffic stop and the police refused to release information, what can be done?

Three family members were riding in a car (current plates, no warrants, etc.) & 'randomly' (pfffft, RIGHT!) by police. Police officer called backup. More backup was called. Persons in car were asked to step out. Persons were scared to death of assault, so rolled up windows and dropped keys out the other window. Officer walked up to glass and yelled to roll down windows or he would break them out. Persons in car took out cellphones and began recording. Officer got on hood of car and screamed to roll down windows or he would shoot. Persons sent video to youtube and posted online while 'scene in progress'. Officer arrived in another cruiser with a tool designed to bust out window 'politely'. Officer used tool and other officer immediately cleaned out remaining glass and pointed gun at those in car. Officer on other side of car did the same.

Police refuse to release the report or names of ALL the officers involved. Only one of the officers names is known. All were wearing jackets.

Persons were booked on refusal to supply ID and refusual to submit to arrest (WTH that means?). Two of those persons were roughed up with injuries, including a bloody lip.

How do I go about filing a hate crime/racial crimes report? How do I get the full report from the police?
A previous request from a pre-paid legal program was ignored by the Police Dept. All other communication has been disconnected 'by accident' by their side or calls not returned by internal affairs.

The victims can file a civil rights lawsuit against the police officers involved. Once the lawsuit is filed, the records can be subpoenaed.

Thank you Stevef for reply.

We are quite scared to death of what happened and still want to know WTH the officers were THINKING that day.

Can i have an attorney write a demand letter to get (ALL) the officer's names and badge numbers? Or will I have to settle for only knowing the one officer's name?

A demand letter has no legal weight. It's only a threat. The police would know that. You can't force them to provide any information without a court order, which is what the subpoena would provide.

Silverplum, had the 3 persons not taken video and protected themselves from assault it could have been murder. Very easily.

I would still like to know who (or what) they were expecting to find in that care.
Over 3 hours later, the officers were very upset that they found no evidence inside the car. Remember those old T.V. shows where the officer kicks at invisible tumble weed? It was described to me like that, by those 3 persons. Quite humorous!

But it did not happen.

Exaggerations for effect are fun in literature and jokes. Not in legal matters.

Didn't happen to you. Therefore, you are not a party and not entitled to know anything, nor are you able to send "demand" letters to the police or anyone else.

Why didn't the driver and passengers comply with the lawful orders of the officers?

What's the chance of me finding an attorney who will take this on?
What's the chance that atty might not like me and decide to call the police to tell them what I told him/her?

btw, we do have video and I smartly removed it from youtube after it was uploaded. We put copies in a safe deposit box.

That is pure speculation that will not stand up in a court of law.

If that sort of speculation were admissible in a court of law, then every bar fight would end in convictions for "attempted murder."

I'm SURE that you can find an attorney willing to take your money...err...THEIR money.

Boy, you really have a victim/paranoid mentality, don't you?

Yes, it was smart to remove it. But, if anybody was able to get copies of it and any accompanying text, you can STILL be sued for defamation.

I don't think anyone can tell you that. No one here knows the particulars to the extent that we could clearly come to a conclusive determination of whether or not (with all due respect) you're legitimate or a crack-pot.

We tend to get more of the latter than the former here.

What's the chance that atty might not like me and decide to call the police to tell them what I told him/her?

Attys are bound by ethics (despite what you see on tv). Your atty will not be allowed to discuss the particulars of your case with others without your express permission.

May I ask why? Why you uploaded the video to YouTube and then removed it?
