A contract dispute arose for a music licensing agreement which I entered into on behalf of my artist. The licensee failed to pay for the use of the song in select videos shown on YouTube for a clothing apparel marketing campaign. Additionally, the licensee went beyond the scope of the agreement by exploiting the name of our artist in over a dozen other videos not agreed to. So we pulled the song from YouTube and canceled the agreement. Now the licensor has filed a complaint in a California court seeking damages which I feel is without merit and frivolous. They claimed that they sent a check for the licence fee, but this check never arrived. Nor did they offer any proof that it was sent or canceled. The agreement states that this matter can only be settled first through arbitration and secondly within the jurisdiction of New York.
