My car been stolen help!

What is the name of your state (only U.S. law PA)?

My pick up truck has been stolen,police are not helping.I let someone used it that was only for 45 minute eran never return it and the person who told it is missing.The guy I let it to is my business parner who is not the owner in solo owner and the police cliam they only can make it as unauthorized used of car.The person is missing,we are thinking he may have been high jack at gun point or something and we dont know where he is.This happen yesturday afternoon,today I spotted my truck driving around in my town,I call 911 and they send a police offer to my home to make a report again.I lost site of it and dont know where it is.The person that was driving my truck today was not my friend,now as for my friend,his wife is going report him missing tomorrow,she was told she had to wait 48 hours after he when missing.I need out,I have insurance and reported it to them but they cant do anything until it turns into a stolen vecile report.So as I sit here,I dont know what to do.Please help,so I call a lawyer?Please help.Thanks

You have no proof that your vehicle was stolen at this time. When you lend your car to a friend and the friend doesn't give it back, that's not theft - you gave them the keys. It's a civil, not criminal matter. Until there is actual evidence of theft, there is nothing the police CAN do.

Bull,I was told after 30 days if my truck isnt found,then it becomes a stolen car.Anyway I found my truck and got it back.

Actually, it can be reported as an EMBEZZLED vehicle after that amount of time, but it is not technically a theft. Larceny, yes ... theft, no. However, NCIC rules would only allow it to be entered into the nationwide SVS database if it has been reported as embezzled and charges have been requested ... I am told some states require that an indictment be issued before entry into SVS.

I am glad you got your vehicle back. But, ecmst12 was right, this is not technically a theft. And, as written, it sounded like it just happened - in which case it would be a civil matter initially.

Dont know havent found are talk to him yet.But something is fishy,his own sister found the truck at a park well know spot where stolen cars and trucks are left.After I got the call about my truck being park at at the park,I called the police,police officer told me my friend may be charge with driving a vehicle without consent.But I did gave me consent but only for 1 hour to used.Im still havent seen him but was told today he came back home.Knock his door no one open it.I know his wife kids,we are like family,I cant belive if he did this.Now what legal action may happen???

If they can show that he broke some law in your state he could be prosecuted for that crime. Otherwise, if the vehicle has been damaged or you have had some expenses as a result of his holding onto your vehicle for longer than you had wished, you might be able to sue him for those damages.

As it is, I don't know that there is a really a crime that can be charged. Out here there would likely be no crime that could be charged. But, each state is different.

Also most 3 days,police did told me he may or will be charge for it.Now since I lost one day pay,can I sue him??
 
if you guys are friends and partners you should try to work it out..maybe he is all messed up after being hijacked at gunpoint?
