My child is disabled and has missed much school

I am from West Central Florida

We had a meeting at the school 2 years ago about her absence's. They told me she missed way too much school and thought I was keeping her home for nothing or because she just didn't want to go.

My daughter is 9, she suffers from OA, Severe Rhinisitis, and Bronchitis, and Anxiety hives. She misses a lot of school every year because she gets sick very easily.

Well at this meeting they called in the State attorneys office. One of their investigators came and he basically jumped down my throat because of this. They primed him before we were allowed in the meeting so when we went in he had an attitude with me and my husband. (we are both disabled also).

I explained that I had Dr. notes for days she was out more that 2 in a row. I told him that my Dr. said she doesn't need to see her if she is sick for one or two days but if she doesn't improve to bring her in or if she has a fever bring her at once. Then I showed him the letter I got from our Dr. that listed the diagnose's of my daughter.

Well, he got really upset with the school people because they didn't tell him she was disabled in that way and he dismissed the meeting and appologized to us.

All was well. Now this year she has been out quite alot. Most are with Dr. notes but there are some without. So I get a letter in the mail and the next day I called the social worker who sent it and talked with her about the absence's. She and I came to an agreement and she was going to find me a good homeschooling program or homebound because she wants me to take her out of school., yes you heard right. :).

I got another letter when I was talking to her on the phone and it was from the states attorneys office. This time we had to go there and have the meeting. So we did. We were on time the principal and the social worker were late. We waited while they went in and presented their case to the investigator. in the mean time my husband was given a contract to sign before we went in. He said for me to look at it and see if I could make heads or tails of it. It said things like. Your child agrees to go to school on a daily basis. Your child agrees to follow all school rules. You will go to school all day with your child. You will take your child to school everyday from now on.

Well I wasn't gonna sign it. I ammended it to say I will send my child to school every day if she isn't sick that day. Then I signed it. That was the only one I checked off also.

Well we got called in and the investigator TOLD us to sit down. Then he proceeded to tell me the contract I ammended wasn't gonna fly. I told him I wasn't going to send my daughter to school sick and he said I will. We yelled at each other and totally went way off the beaten path.

Well to make a longer story short cause I am plum wore out from the stress of it all. He forced me to sign that contract with the things HE checked off on it and he also forced my daughter to sigh it and she is only 9.

I told all the people in that room that I am being forced to sign this paper under duress and against my will. Under pressure. They did nothing. Then he told my daughter to sign it and I said no she isn't old enough to sign legal papers but he didn't care and said if I didn't do this I would be charged with a misdemeanor.

We left. I thought I was gonna have physical problems from my disabilities from the immense stress!

I called the District school board on this and complained that they didn't follow the Florida Statutes and they were by law responsible to follow them. I also told them we were forced by intimidation to sign that paper. I told them if I can I am seeking leagal action against the school for the harrassment.

I called the State attorneys office and asked to speak to the actual State attorney. They gave me a long distance number and I called today. They gave me to his secretary Eileen and she said I had to tell her what this was about or she wasn't going to give him the message. I told her my name and phone number but that I would rather not disclose what it is about for now. She said good bye and I said to her wait a minute, I just don't want to say anything as to what happened because then the people could cover up what they've done. She said she wanted to know what happened and I refused to tell her. I said ok make me an appointment to see him please and she said he doesn't see the public. (Well he is an elected official!). I said ok how about if I take the 2 hour drive and wait in the waiting room till he has time to speak to me? She said if I did she would have me removed from the office by an investigator!!!!!. I couldn't believe it!

She hung up on me. I called the Governors office and after speaking to 5 different people they finally called this State Attorneys office and I was then able to leave him a message.

He still has not called back!. I am fuming. Our rights were violated and I can't get anyone to listen!.
