My Child Needs Braces

Our daughter needs braces. This is not a "cosmetic" issue; she has some serious directional malformities of several molars and canines. She's had 8 baby teeth pulled over the past two years to allow her adult teeth to move - just to prepare her for orthodontia treatment.

Earlier this year, my ex and I went to settlement conference where I offered to pay for the entire cost of the braces if he agreed that the arrears of $1300 were satisfied (this would have been his half of the cost of braces). He did not agree.

I've now figured out a way that I can finance the braces myself over a two year period and the orthodontist will work with my plan. I am not asking ex to contribute.

Since I am not the legal custodian, do I need my ex's approval and signature on the consent form (not the fee agreement)?

I'm concerned that the older our daughter gets, the longer it will take to correct her teeth. Also, once she is out of school and off my insurance plan, she may not be able to afford them.

If ex does not agree, can I file a motion with the court?
