I am in the state of New Jersey. I did not see my children who are currently 7 and soon to be 6 for almost three years. I was in the army, and when I came back, she moved with out leaving any information with me or my family. When I called her mother, she did not want to "get in the midle". During that time, their mother got married and had two more childred. Because she wanted all three to have the same name, she started telling my kids that there last name was their step fahter's. I have talked to her and the school, but have gotten not where. Their mother said she would work with them to get them back to my name. She now says they do not want to use my last name. However, the kids tell me she says they do not have to. The school says I need something in writing from court or a lawyer saying they have to use their legal name. They are refistered under my name, but are using their step father's. I have been seeing them for two years now every weekend, paying child support every week, and it hurts me that they are not using my name. To me, they are acting like the step father is the real father. Please let me know if I spend the money to go to court over this if I have a case. I am afraid they will say she can keep it this way becuase the kids are used to it ( Evem though she should have never started it in the first place).
