What is the name of your state (only U.S. law)? florida

my dad forced me into giving my baby up and the day i came home from hospital with baby he kicked me out he lives in the middle of no where and i have no friends or other family to help me. so i gave my baby to the people who my dad wanted to give the baby to instead of us both being out on the streets. in fl they do not practice common law marriage and my dad got a lawyer from co because that's where the family is from as well they practice common law marriage there. the people are in no way related to me, my baby, or my dad but his live in girl friend...is there anyway i can get my baby back before they decide to get full custody then go for adoption?
*i meant daughter in the title

Where is the baby's father?

How old are you both?

Have you signed ANY paperwork?

What does common law marriage have to do with ANYTHING?

reply

the father of the bay and where i conceived the baby is residing in the state of NY he wants nothing to do with us and has denied the baby

i am 22 about to turn 23 the father is turning 29 today

i was forced into signing papers because of abuse while pregnant

because in FL if there is a temporary custody case the people trying to get custody needs to be related to the mother in someway

There is NOTHING in the entire Florida code saying that a third party must be related to the mother in order for that third party to file for and/or obtain custody.

NOTHING.

But, if you don't know what you signed - honestly, there is nothing this forum can do for you.

You'll need to speak to an attorney.

you need to get a copy of those papers NOW and speak to an attorney.

Absolutely. I guess it's too much to ask for people to understand what they're signing before putting their name on the line?

It may be possible to have an attorney appointed for you by the court - at the court's expense. I don't know if that's true in FL (can someone please check), but it is in many states. At the very least, the court will probably appoint a GAL or mental health professional to determine what's best for the child.

I guess I have little sympathy for a 22 year old who lives with Mommy and Daddy and still has no friends, no family, and no backbone, apparently. No means of support, yet she's out having babies. In addition to getting an attorney, I'd suggest that it's time to grow up and become responsible for your own life.
