I have no clue where the biological sperm donor is. He has never seen my son. Last I heard he was sent to Texas when he beat me trying to cause me to have a miscarriage the day we found out I was pregnant. He has been found for child support and is over $4000 behind. Pro is right - you're going to need an attorney. You're also going to need to be able to contact Dad.

Note, however, that it is unlikely that you'll be able to terminate Dad's parental rights until you have a new spouse who is willing and able to adopt the child.

Those links deal with when the STATE wants to terminate the rights of BOTH parents due to dependency/neglect/abuse. They do not appear to apply to a step parent adoption.

You're right. I was just reading OP's post and didn't look at the title.

If stepdad wants to adopt, it's at least possible, but OP will still need to serve Dad with the appropriate papers. They need an attorney - it is not a DIY project.

I wonder if the OP realizes that when/if this adoption goes through that the new father will have equal rights to "her" child when they split. OP, do you realize that you will have to share custody with this man in the event you divorce? Does you know that he may have to pay child support, or you may even have to pay child support if this marriage is terminated?

You also do realize that child support from the child's father will cease to exist, right?

If he has been found for child support, someone knows where he is - get an attorney - he/she will know the proper way to handle this situation.
