I just purchased a home with my boyfriend 9 months ago. We have been together for 3 years. My boyfriend(not the father) and my son do not get along at all, since my boyfriend has yelled at me on several occasions. My boyfriend gets mad at me whenever I leave the house, although he can come and go as he pleases, staying out drinking after work, etc. I am a non drinker and never go to parties or bars. The last time I went over to my parents house 1 minute away from me, I was there for one hour and he got mad at me. When I got home he told me that he wanted me out of the house. On another occassion, I went to a girlfriends house for dinner, he didn't want to come along, when I got home he locked me out of the house but I managed to get in anyway, he literally picked me up and was gonna throw me out the door. So this has been twice so far that he has told me to leave. Then after the fact he tells me that he doesn't want me to go. My son has had it with the way he treats me and now we both want out. I am not in the situation nor do I have the funds to move out and start over again. I promised my son that once I can save the money we will leave, but my boyfriend is totally unaware of our intentions. My question is, what are my rights to the house we own together, does he have to buy me out? If it could happen I would like to see him leave, but I know that will never happen. Just need to know what to do. kanmc

Deed details

Boyfriends name is first on the deed, does that really matter? I pay half the mortgage, and all expences for the house.

Yes, it matters. He wouldn't have asked the question if it didn't. And I think he will come back AGAIN EXACTLY how the names read on the deed. That's the only way he can answer your question.

It doesn't matter what you pay. If you aren't on the deed you don't own the house. Simple as that. If you are not on the deed you are a glorified tenant.

write here EXACTLY WORD FOR WORD how the names are listed on the deed.
 
They are trying to find out if your are listed ie: joint tenants with rights of survivorship, tenants in common, 1/2 interest each, etc.

I doubt word for word includes "survivoralship, 1/2 interest etc." BB's not asking you for his health - type out EXACTLY what it says, word for word, completely.

By the way, if you want him to be the one to leave, and he agrees to you buying HIM out, you will need to refinance the mortgage in your name alone to get his name off and pay him his equity?
