My rights were violated

I believe my rights were violated here is the entire story and what I believe has been violated

I'm 16 years old in Pennsylvania, I was caught on SUSPICION of shop-lifting by a security guard who physically forced me into a room. He then stood by the door and asked me a series of questions, the police were not called until I refused to answer a question. When the police got there I was asked the standard questions, my name, address, parents name. I then refused to answer one of his questions and I was arrested at that time, and kept in that room. Upon, stating that I had a right not to speak I was told that I stole I have no rights. When we were getting ready to leave the security guard asked for the items that were in my pocket. The cop then started removing the items from my pocket without asking for my permision, including the items I stole. I then was tooken by the arm into a police car and taken to a police station(or sub station, not sure) for finger-printing and to have photos taken of me the cop then told me "If you don't stand up I'll have to physically stand you up" I told him " I have a right to have my parent or legal counsel present" he tried to stand me up which I physically resisted and he then stopped. They then called my parents to have them come in. They then had another cop come in and tell me that they have the right to "process" me and if I don't I could be taken directly to jail for it. I then willingly was processed, and moved to another police station. My mom was waiting outside of that police station although I was not allowed to make contact, I was taken through a side-door and placed in a jail-cell. While I was in the jail-cell, the cop and my mom were talking and he also told her I was caught stealing I have no rights.

I've been pretty specific and I believe many rights have been violated as follows: Wal-Mart has the right to detain me but only if they attempt to have the police there as fast as possible and not hold me without FIRST notifying the police to arrive, I was searched while handcuffed and not asked whether or not I'd like to be searched, I was also arrested,physically moved, and proccessed without contacting a parent, I also believe that my right to be treated as innocent until proven guilty was violated, and I was specifically lied to about my rights.

Also do I always have the right to an attorney? Do my parents finances affect my rights to have one appointed?

You have a right to remain silent and to have an attorney present during questioning. Other than that, you have no right to have an attorney holding your hand during processing or any other time during your visit to your local jail


Do my parents finances affect my rights to have one appointed?
Yes they do.

Agreed.

Everything that happened was perfectly legal.

You are allowed to be restrained.
When placed into custody, you are allowed to be searched.
When brought to the police station, you are allowed to be processed without a parent or lawyer present.

You had rights... what you are saying is that no one gave you that Miranda warning you heard on "Law and Order". Wasn't necessary... you were caught in the act.

Oh, there's no such word as "TOOKEN".

I also find it funny that OP is offended that the guard even removed the items he stole from his pocket. LOL He should be glad he didn't get a cavity search.

Maybe we are being too judgmental.

Maybe his is just like Jesus Smith, that guy down the block that does such wonderful things with cheese.

Understand one basic principle - you're a thief. This is not the only time you've stolen something, it just happened to be the only time you were caught. Instead of acting like a mature 16 year old and being remorseful, you're whining like a five year old.

I hope your mom takes away your driver's license, tosses your cell phone in the garbage can, removes all access to a computer, puts you on a strict curfew, empties your room of everything except a mattress, takes your bedroom door off the hinges and puts it in the garage, and gives you tons of chores to do around the house. Oh, and also make you go to the store and apologize to the store manager. That's "in person" not via email or phone. You also need to apologize to your mom for being such a brat.

Stay in school. Learn to spell. Learn to use paragraphs (with indentations or spaces between paragraphs).

tooken = taken
jail-cell = jail cell
jus = just

One more thing, juslikejesus - learn to be more respectful. That whooshing sound was the comment going right over your head.

A note to my colleagues: when I ran this post through spell check, it suggested "sulkinesses" instead of "juslikejesus". Sometimes you just can't make this stuff up.

Did you miss, BOR, that it was a cop and not a store employee that took the items out of his pocket? How does that translate to a 16 year old admitted thief owning the company?

Yes, I missed that, I thought it was the store employee, thanks for the correction and the cavity search was based on the kid owning the company, not the pocket search, although in Ohio, the merchant is not allowed to search, but states are different.

The point about a cavity search is still alive for the cop then, OR whoever would have done it as Stealth implied.

The cop emptied his pockets without his permission. Among the things the cop removed were the items he stole.

Hope a copy of that post is made for court.

I don't think Stealth was suggesting that a cavity search might have been done by anyone there in the store. At the police station before being taken to a holding cell, perhaps.
