my son is a year old now his biological father has come into his life and is wanting his last name changed to his.
I agree with it but how do I go about getting his last name changed. My son carries my maiden last name, but I would like him to carry his fathers...there is no father listed on the birth certificate..we are in the state of arkansas.

You need to contact the clerk of the court in the jurisdiction where you live and ask for the "name change of a minor" paperwork packet -- it will be complete with all the documents you need and the instructions of how to fill it out and file it -- you complete the papers, pay the filing fee, file your petition and follow through from there.
You state he is not on the bc - is he legally recognized as the father (was there testing done to confirm paternity?)....if not the court may order that the testing be done to be sure he is the bio-parent and can therefor give his permission for the change. As you are both in agreeance to the change it is unlikely there will even have to be a hearing -- more likely that after the initial waiting period once you have file the petition (period is there to give either party the chance to object) you will file your final motion for the judge to sign the order and the change will be in effect -- you then need to go about obtaining an updated ss card for your child.
