What is the name of your state? TEXAS

Affidavit of paternity
My ex won’t sign it. Yeah, she wont. What next? Court ordered paternity? My Son is 5 now and I've been a part of his life since he was 6 months old. I have a court order that outlines visiation and child support, everything is up to date. I never got a DNA test but the judge in NV allowed me and my attorney to just claim him as my own (and trust me, he is mine.) I need to get on the birth certificate, she's no help. What next? :o

Why wont she sign??? GO through court have Dna test done. more than likely you will be paying. I hear it is cheaper than private dna tests though. Not sure what follows after you are proven father though. HOpefully someone else can help.

She refuses to coperate with anything I try to do. So if I do the DNA, I still have to get it through some kind of judge approval?

Call the office of vital statistics in the state where your child was born. Tell them you have documented, court ordered visitation and custody orders and that a judge determined you to be the father. They will tell you exactly what you have to do to get your name on the birth certificate. States are different when it comes to requirements. If you get lucky they will consider the documentation you already have enough to have the child legitimized and put your name on the birth certificate.
