What is the name of your state (only U.S. law)? FL
My x husband lives in Ohio, I live in Florida. He use to live in Florida and that is where our Order for Support, Income deduction, all Orders as a matter of fact are from FL. I have been a client of CSE here in FL for over 7 years now. My x husband has been in and out of arrears ever since our divorce over 12 years ago. His balances have been as high as 9,000 something to as low as zero. He has not made a payment now since Spring. I found out CSE here in Florida has asked Ohio to help them (Interstate Child Support they called it).
I also learned that my x is living with his brother, working for cash (his brother owns his own business) so I guess one of my questions is if a NCP is bent on not paying their CS they really are not going to pay and no matter how much or how little CSE does to compel them it won't matter? Furthermore, is it difficult to impossible to find a judge that will acutally take sanctions against a NCP that is in arrears, as far as issuing a warrant, issuing is a WRIT? Where they take their bank account or personal property?
My x has been found in contempt of court 4 times, and is looking at possibly a fifth next month. I had him served in Ohio and have a case pending here in FL. I dont even know how all that will work out since the Interstate case is going on, however the Clerk of Court issued a Default against him.
Why is it that CSE takes SO long to do their job? I know they have alot of cases to work, FL is huge. However, it seems whenever I call it takes 30 days to anything, answer a question, anything. They would not even take down my x husbands address, they said they had to verify through the post office and that would take 30 to 45 days. Yet I sent them proof that I had just had him served by the county sheriffs at that address. It seems like the system in some ways is working against the kids and the CP.
Its frustrating. Meanwhile, his arrears continues to mount, and I dont think he will pay another dime until he serves some jailtime. So I wait and not so patiently wonder what will happen once Ohio finally imputes my information in their system (which they have had since mid july).
