ncp not showing for visits

ncp lives out of childs state,so [set] visits were granted to ncp,and again we sit and wait and again the ncp not show up,petition the court?this arrangement makes it his choice when to come to childs state? verses what was set,,{every month} consistancy which he shows none ,little alone stability..so now can i go to court to change this-

No, because unfortunately you cannot force a NCP to visit with their child(ren). You can force them to support them financially, but not emotionally.

The best way I have found to handle this is to have the order modified to state that when the ncp chooses to exercise his visits, that he must notify you in writing within 7-10 days prior.

Most courts will do this with a parent that is inconsistent with a visitation schedule. This is to prevent the child(ren) and cp from sitting around waiting weekend after weekend for ncp not to show and the child(ren) being disappointed.
