ncp wanting custody back...

What is the name of your state? OHIO

Recently (last month) a guy friend of mine gained custody of his 10 year old son via mutual agreement by both parents...now three weeks later Mom is having second thoughts about it because she decided she doesnt know his girlfriend well enough and of course she doesn't like her....
She has been telling the boy things like "your dad better make sure you take a shower every night or I'm going to have to take you back, because he isn't taking good enough care of you."
and she is always remarking about how she hates the clothes he is wearing saying he looks like a bum...it is my impression that she is just looking for a reason to take the boy back... does anybody know how likely it will be for the Mom to regain custody if she were to take the dad to court?

The court is not a see-saw. She would have to have good reason to do this now, and at this point, a judge may or may not even hear her case if this was that recent.

She could fight it later, if she has evidence that it is in the best interests of the child. But a few weeks, unless the child is seriously abused, isn't going to cut it.

She would have to go up against the same judge and tell the judge she "changed her mind.' That won't gain her custody.
