My neice has been in foster care for a long time and has recently turned 16. The state, as of yet, has not terminated her mothers parental rights and her mother refuses to sign for her driver's permit. While my neice was driving a friend's car, she was in an accident (minor) and now, she is in adult court facing jail time for driving without a license. (This is in Kentucky) I'm at a loss of what to do as are my neice's case workers. I need some advice that I can pass along to keep my neice out of jail. SHe's a great kid, straight A student who wants to go to college. Her mother could care less one way or the other and my hands are tied. Any advice would be Greatly Appreciated. Her court date is Sept. 21.

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

There is little chance she will actually do jail time. Best thing to do is to get the court on your side, make the court feel sorry for her.

You need to find an attorney to represent her. Try attorneypages.com or your state bar association and ask for lawyer referral. many of them offer pro bono services or low cost representation.

There is no excuse for driving without a license. Her act was irresponsible and careless. I feel for the person whose car she hit. Their insurance is probably going to go up. I think she needs to pay the price for what she did and it would be a good life lesson for her.

I understand that she at least needs probation or fines and community service but, I don't think jail is the answer for any kid who has never been in trouble before.
