I am in the process of an amicable divorce (knock on wood!)
We have drawn up a settlement agreement which includes monthly child support. I am the soon to be xwife & I will have cusdody. I am agreeing to a much smaller child support monthly payment than the the courts order due to my husband's earnings.We are self employed. He promises to up payments when he makes more.We love one another and he is being more than fair on everything else. I worry that he is being generous up front to save in the long run. I can not blindly trust in a matter as important as this.
My question is this, If I sign that agreement and if his wages go up and he doesn't do what he says can I take him to court? Or am I screwed because I signed the divorce settlement containing the small monthly payments in the begining?
Also since he self employed and doesn't get a normal salary can I have his tax return ordered to court to prove that his earnings went up if it becomes necessary?
