I was charged with Public Intoxication and resisting arrest... The P.I took place inside my vehicle in front of a bar. First police office asked for me to call a ride to come pick me up because he noticed I was intoxicated. I told him I had a ride and was waiting for my friend to pick me up, he said ok and this took place while I waited in my vehicle for my friend to pick me up. 10 minutes had passed and I pulled my vehicle 2 feet back and then 2 feet forward because it wasnt parked right to do the person that parked next to me from earlier. A police officer then walked up to my car and gave me a PI because of me moving my car. Now my PI is dimissed but my court appointed attorney said we need to plea bargain on the resisting arrest because I could now get slapped with a DWI conviction because they have it on tape of me moving my car for 2 seconds. MY MAIN QUESTION is can u be charged with a DWI after 5 months have gone by and I was never arrested for DWI to begin with..My trial is at the plea bargain stage on tuesday and I just dont know if I buy what my COURT APPOPINTED ATTORNEY says about a possible DWI conviction as well because they have me moving my car for 2 seconds to realign my parking...So basically can I be charged with a DWI now after all this time?
