Here's the deal, This situation is not mine, but a family members. My uncle who was in the military, and got divorced while in the military, paid out child support to his ex wife, for his first daughter. (they only have one child together) Later on, his ex wife went and said he didn't pay child support, when indeed he was, unforunately the military was worse than it is now back then, and they took more money out for child support. So in turn he's paid double on child support. During this entire time, he's rarely been allowed to see her, as her mother has said things to her, making her not want to talk to her father. So at this point he has seen her very few times. Even when she's been back to florida to visit.
We now have belief that she may have been adopted, or possibly using her step fathers last name. We do not have any proof of this, but are trying to gather proof. There are several things I want to find out.
We know it is illegal for her to be adopted by this step-father, because my uncle has not given up his parental rights. What I want to find out is, what would happen if it's proven. Besides that the child support will be paid back to my uncle. Does the mother get in trouble for signing false documents? Does she get in trouble for a form of kidnapping? What would happen to her if this is proved that her husband has adopted my cousin? What would happen if she was not adopted but my cousin is using the last name on legal documents, for example School information?
I am also looking for ways to help find out if it is true. She is still a minor, but unforunately we're trying to go about getting the proof, so maybe in turn my uncle can use it to be able to see his daughter. (He doesn't really want the child support back, but he does deserve the child support back) My uncle now has two more daughters, and they don't even know their half sister. This situation is tearing apart my uncle, who deserves to at least see his daughter, unforunately she's at the age she can decide, and her mother is not helping the situation. Any help anyone can give me would be greatly appreciated.

Is he the legal father? Were they married when the child was born? What does his current custody and visitation order state? Why hasn't he pursued it?


We need these answered to give more help. As I see it now, taking common answers, if he has been denied court ordered visitation, he should have taken her back to court for contempt. If he didn't do this, he has no one to blame but himself. If he has had no contact with the child for certain amount of time, then it is possible the child was adopted. Does the mother know how to contact dad? If he let this go on and didn't pursue it for this amount of time, he may or may not be out of luck.
