My friends band has just acquired a gig at a local club. The band and the club owner agreed in writing on $5000 for four weekends of work. At some point during the contract discussions the club owner was worried about whether or not the band would draw in enough customers and insisted that as a condition for signing the contract the band agree that if the club does not bring in a certain amount of business that the contract can be terminated by the club owner. there is no record of this agreement
Last night they received a call from the club owner canceling the contract totally
Can they sue for breach of contract?
