I am near the breaking point. I have been putting up with a terrible situation.
Jobs are hard to find in my area. Thousands are out of work. I work for a 2-owner / 2 employee specialty furniture store. One of the bosses is very nice but intimidated by the mean one. I was hired as a salesperson at $10. per hr. + commission when most jobs around here are about $7.50/hr.( if they are full-time). After 30 days I was TOLD that I would be getting a raise. Instead of 800. per pay period I would be getting 900. but I would be salary and it meant no overtime.
We work 6 days per week with overtime running 3-5 days per week. During tent sales, we work 13-14 hrs/day. I figure that by now I have lost about $7,500. in overtime wages. To make matters worse, instead of taxing at 25%, they tax at 9.25 %. After seven months I had only paid $220. into federal, 350. into state, 200. into medicare & 840. into social security. I owed a lot of taxes in April.
I have never received one dime of commission. I was told that I had to make $1000./day in sales consistently before I'd qualify. I am allowed to present to customers but the bosses take them over if they are buying so my name never gets on the invoice - only theirs. Some days the total for the entire store is less then $1000,. so I will never get commission.
Is it legal to do this with the overtime?
Is it legal to do this with the taxes?
Is it legal for them to dock us 1/2 hr. pay each day for lunch - and refuse to allow us to take one? ...and work us 10 hrs. and give us 10 mins. to eat and go to the bathroom?
Was it legal for him to kick the door in on me when I was in the bathroom for 3 mins?
Is it legal for him to call us "fu--in' a--hole pu---whipped motherf---ers"?
Is it legal for him to have drivers work there for a month and not have them fill out the hiring paperwork?
Is it legal to pay us late? We get paid on the 3rd & the 18th but I have waited as long as a week to get paid and frequently am paid 1-2 days late.
Is it legal for him to call us "fu--in' a--hole pu---whipped motherf---ers"?

Most people would not believe what he has said & done. I think he is a splitting borderline personality. The nice one told me that there was 22 people in my job before me in 4 1/2 years. He wants out too but the mean one will not buy him out and he can't afford to walk away.
