What is the name of your state? California



When there is a motion to "compel arbitration", what exactly does that mean?

Does a judge decide over it or does he appoint a panel to oversee it?

What happens if the plaintiff wins arbitration? How is it handled?

The motion is a request to the court for the judge to enter an order stating that the parties must arbitrate the issues rather than to litigate them in court. The arbitration panel must be put together as indicated in the arbitration agreement. The decision of the arbitrator(s) is as final and binding as any court order and subject to appeal in most jurisdictions only for arbitrator bias or the arbitrators' manifest disregard of the law.
