I really need help here. I hope it that you bear it with me, it is quiet long story .
I know a person who has been tortured in her native country and fled that country and came her in false document. She applied for asylum and her INS interviewer couldn’t decide on her case and referred her case to and Immigration Judge.
The Judge denied her application on basis that she doesn’t have enough document to prove her identity, even though she had presented enough Affidavit from people who knew her and who can attest to her identity.
The Judge was Unfair in her rejection especially since she also denied her With-holding of removal (CAT). And denied her Employment Authorization so that she can support her self while she is waiting for the appeal court.

My question is how can she get work permit in order to support her self, even if it is a temporary one. I want to know what the INS expected from that person to do here while waiting for appeal answer knowing that her native country is under civil war and there is no government status there only warlords. It is not safe to go back home even UNCHR admitted that in her last year report. Especially for minority clan which this person belong to.

I am really in dilemma her , everyone knows how is to live here and she came her running for her life.
Any advice that you are willing to provide ,is highly appreciated.

If the INS has denied work authorization then there is nothing she can do to work legally. I do not know if she has an immigration attorney, but if she wants to stay, then she needs to get one.

She does have one but I thought that there is more could be done her lawyer is and efficient one but she doesn’t have that much experience and it is one of the free lawyer provided by the INS.

I thought by looking around with someone more knowledge in the Immigration Law that can tell us what to do instead of her doing anything illegal like use of other person work permit, which could jeopardise her case. Since the appeal court here as you know take years for them to reach any decision. It is hard to believe that the Law her will allow to appeal but will not allow you the mean to support your self.

If the court has denied her permission to work and it is pending appeal, then there is nothing that can be done. The INS are hoping that by not having an income she will commit a crime or leave the US. Sorry I can not be more help but until the appeal, I am not sure what her options are.
