Please advise, I own a small trucking company here in Dutchess County NY, presently I rent open space ( no building just parking area) since Feb 2004. The hand shake agreement was with the owner of the property for $250 per month CASH only and pay directly to Electric Company our bill. They owner refused to accept any checks it was a cash deal only or get out was his answer. Our rent was never late or he would never stand for it. In July 06 he died, his children who he somewhat disowned, had nothing to do with them for years, were right there because so they say he never left a will so presently there is an ESTATE, as none of the kids get along either, they are out for money only!! In August 06 the daughter came to me stating I owed her rent and some misc money, so I paid her in check form believing it was for Aug 06, as I paid the father in June 06 cash for july"s rent before he went into the hospital. Then at end of Aug 06 the daughter who is the exec. of estate stated our rent has increased to $600 month, NOT IN WRITING VERBAL, to my son who runs the business. So since Sept 06 each month I have paid $600 befor the beginning of each month. She know states we are behind a month, I have never heard of such a thing that you pay after the fact of renting and we never received written notice for the increase either. We have never signed any agreement before the fathers death or after with his Estate. Now this month she state we have to pay the back rent and she even state we own money before the father died or get out by Dec 31, 2007. Can she do this legally! Next today we had a sever Ice storm she has refused to sand, salt the driveway on the property which has prevented us from getting our vehicles out of the parking area we have lost business due to her refusal to keep the area safe, which also caused one of the drivers to slip and fall needing medical attention. The daughter was advised of this and slammed the door in our face refusing to talk to us. What should we do!What is the name of your state?
