Subject: Discrimination law suit
Against the DMV Department of Motor Vehicles
I apologize for any grammatical errors their might be right now I am not in the best state of mind.
My name is (name) and I have experienced Discrimination from the DMV plus have experienced deep emotional stress. I am unable to function after what I have experienced, it has placed in a sever state of depression, anxiety, emotional stress, disrupted my life, and emotional scaring. My case is that I am bioptic driver which means I require a special telescopic lens to drive with and it allows me to see beyond my vision range to a degree of 20/20. This is a special license the requires special schooling consisting of 140 hours of drive time experience and 80 hours classroom examination. The hours may be more or less depending different variables. Their is also extreme testing from a local affiliation, dmv, specialist low vision doctor, and medical determination board. My license is renewed every year on my birthday of which I must be medically determined that I can fulfill the vision requirements set forth by the dmv in order to receive a renew for my license. This year was a hellish nightmare that I should not have been discriminated against. It began on Oct. 5th 6 days before my license expired. I contacted the medical review board to seek information about what to do because I had not received any information about the renew of my license. I contacted Roxanna who is the individual over my case. I have recorded all of my calls. I was notified that I needed to see my eye specialist in order to get medically reviewed for my renew. This was the first call and no issues were found. I expressed concern about the shortness in time that I had in order to renew my license. She admitted on the call they probably did not send anything because they are behind on their cases. I told her that I lived a new address which I had my mail forwarded too and that I had difficultly in receiving my mail. She then asked me if I had gotten into in accidents. I said and explain what they were, I had 2 at fault over a year they were both in august and 2 not at fault. Which one of the at fault ones could be disputed but I would need a lawyer on that to get footage from a camera from a federal building. Anyway, I was honest about it and she told me to be careful so we said goodbye. I did call back to ask her a question but she just transferred me to a different department. The next time I called was on Oct. 8th call recorded. After coming from doctors to tell her I passed my vision test. I tried to cordinate with her because she has to write a letter to dmv to pass my vision screening. We just mostly talk about the procedure of what to do when I get to the dmv. So again no issues were brought up and everything was fine. I contacted her on a Friday and she had left the letter their for me to get on Saturday October 10th. After coming in to the local dmv after I requested a gentlemen took me to the side and told me they would not renew my license. Of course I was pretty upset asking why now, Why did you wait, how come etc... The answer I was given was that they feel I am unsafe driver who the city attorney needs to review my case which made not sense. I expressed concern at my license to expire the next day and was promised I would get a chance to defend myself. Of course I never did but I was promised unfortunately I could not tell you what the gentlemen name is however I think I can find out. Monday was holiday and I was never heard back from anyone like I was promised and no one called me. I called again on the 14th of October asking for explanation. When I finally got through I spoke to R again stating that I had to get back to work or I was going to lose my job. I help other people and run my own business. I can not get work without a license that effective make me unable to support my wife, myself and our pets. She said I needed to contact XXX to be reevaluated. I expressed that this was all done at the last minute which should not have been. I did not even have any paperwork for anything. She stated that they had a meeting with the commissioner about the reevaluation. I expressed that I do not feel right in matter when I only had two at fault accidents which I informed her one them will be disputed. I told I was aware of other people who has had 4 at fault accidents who still have their license. I expressed that I felt as though I am being discriminated against and should not be called a unsafe driver. She made it very clear that she did not say I was a unsafe driver however according the dmv handbook
In the new book it only said that they can only deny a license if they feel that person is unsafe. So they are basically saying I am a unsafe driver which their is no support evidence other two accident which had nothing to do with my eyes. It is very convenient for them to just write this off. I was never given a opportunity to defend myself. How is this right and fair for disabled individual?

Re-examination of Drivers You may be required to take a medical, written, or driving examination if the Commissioner of Motor Vehicles has good cause to believe you are incompetent or otherwise not qualified to be licensed. After you have taken the examination, your driver’s license may be suspended or revoked, or you may be issued a restricted driver’s license. Refusal to submit to this test is grounds for suspension or revocation of your driver’s license.
I do not believe I warranted a reevaluation I believe the only reason why I have to go through reevaluation is because I am disabled. Having two at fault accidents with 2 years is not that big a deal enough to re exam my driving. After being told that I am a unsafe driver it has caused me emotional problems. I took the retest recently and fail the test. Too much pressure was placed upon me cause major emotional stress. I am a complete mess and I am now unable to function. I took the test really nervous, scared , and anxious so I did not do well. It is not right what I went though and this is a ongoing issues with bioptic drivers. I plan on in the future try and change this. I would like to share a comment that shares in beliefs that as whole we are discriminated against. It hurts to know that they will punish you if you miss a car payment, or that they can just say we no longer want you to drive. We are not treated the same nor are even given the same rights.

Bioptic Users Unite This is an open letter to people who use bioptic lenses for driving. I am writing to you to ask for your cooperation and assistance in exposing the discrimination drivers using these corrective lenses inevitably confront at the California Department of Motor Vehicles. I know what I’m talking about. I’ve been driving for over 25 years, 19 with bioptic lenses. I’ve been ridiculed, insulted, disparaged, lied to, and even turned away by DMV employees who were just plain angry about having to deal with my “special” case. For years I thought this abuse was only happening to me. But I’ve learned recently that I’m not alone. Every time I renew my license I know I can count on weeks of anxiety and apprehension, sleepless nights trying to anticipate what they’ll hang me on. There is the routine interrogation - where did I get my glasses, how long have I been driving with them, which DMV station licensed me and more. With each examiner I get a different interpretation of the law and how it should be executed. After jumping all those hoops, I hold my breath and wait. From my experience with the California DMV, there is no consensus regarding the bioptic user except to keep them off the road. DMV examiners seem more hostile about testing drivers with bioptic lenses. Are you seeing the same responses ? As individuals we are vulnerable to the institutionalized ignorance and loose interpretation of the state’s policy for driving with bioptic lenses. We have to back each other up. I think that together we present a united front against this routine discrimination and violation of our rights. These discriminatory practices must be stopped. Until very recently I enjoyed a very successful career as a broadcast journalist and television writer/producer. Although I’m not in the trenches at the moment, I still have many friends and colleagues in both print, radio and television. We are at the center of an injustice. Our situation is compelling and something many people can and do relate to. As the population ages, there is no doubt that more of us will be using new assisted technology to drive. Agencies like the DMV can’t resist the change and we have to help them develop new attitudes though our courage and determination.
