Need some advice please!!!

Okay....let me see if I can simplify this....my husband has three children from a previous marriage....ages 17, 15, and 11. The oldest has expressed interest in coming to live with us when he graduates from high school and attending the local community college. My question is...does the support automatically drop when a child turns 18 (the divorce agreement stipulates that support ends at age 18) or does my husband need to file for a modification? Also....would it be wise for us to separate our money now so that what I make is independent of his when they look at income for a new support order? Thanks for any advice!!!

In order to stop the support a petition for modification would have to be filed - and also you need to be aware that in Florida support may be extended past the 18th birthday if the child is still in high school OR attending secondary education (aka college)....I would definately suggest clearing this all up through legal action (the peititon for the modification) because there are so many factors -- the child will be attending college (which would qualify for the extension of support) but will be living with the father (which "may" qualify as a circumstance warranting support stopping for that child). Your best bet is to speak to a family law attorney in your area and lay it all out so that they can give you specific answers based on their knowledge of the MO of the family court system where you are............use the "free initial consultation" most offer......
