Hi Thank you for answering my concern. I am an immigrant. My wife is a US citizen. we got married 2 1/2 years ago. I hired an attorney to present my case to get my green card. I paid my attorney $3500.00 fee for his services. I known the attorney for 10 years. He tried to represent my case once in 1996 to get my green card via employment. Due to my previous owner dissolved his company, eventhough, I was approved by EDD but couldn't continue my case. I still paid about $3000.00 for his services
When I met with my attorney for my marriage case, he mentioned that since I have applied for my case in 1996, I will be grandfathered in for 245i. And there won't be any problem.
My attorney's assistant said that the reason my attorney charged $3500.00 so that he can appear on my case. Otherwise, he would have only charged $2500.00
The day of my interview, my attorney didn't come to represent me. One of his new less experienced attorney came to represent me. And he just found out the day before that he didn't have any information about my previous case. (approval papers from EDD etc.) My interview was ok, except, the immigration officer wouldn't grant my green card due to not having the proof of my previous case to grandfather me in for 245i. My attorny suupose to bring that to the interview and they dropped the ball.
4 days later my attorney found the papers and send it to the immigration officer. And he advised my that within a few weeks. I would have my green card in the mail. In the mean time I should have received my work authorization already about a month ago.
It has been a month since, he sent all the paperwork to the immigration officer. I don't have any news. I have not even gotten my work authorization. and I told my attorny to sent the copy of my records and he hasn't sent to me for 3 weeks. Whenever I call they said that they forgot and they will send it today.
Finally, I asked my attorne to follow up on my case, but he want to charge me more money to follow up. Because he said that the fee I paid is only to represent me at the time of the interview.
I am sorry for the long story. But my question is since the delay is due to their lack of preparation, is it my right to have them follow up to findout where my case is this point or do I have to wait much longer before I follow up on this case?
My attorny is saying that I am being too impatient, that it will take 3 months for them to respond to me and at this point I just have to wait. And he has done his job. Anything more will cost me more fees
Can anyone get me answer as to what do I do at this point? I am a littile dissappointed and don't know where to go or what to do?
I really Thank you who ever you are trying to answer my question, I haven't seen my mother in 14 years. I am really hoping I will have my case finalized soon
