Hello, I feel like a turd waiting till the last hour, i wish i had pushed harder earlier in the week when we got a notice of eviction but the attorney said he will work on calling the bank and get back to us asap, here i call him the night before and i am hoping to get some quick advice from anyone who may have been in the same situation or understand the law better than I do.
We live in Oregon and our house was judicially foreclosed on by Fanie May back in January (about 90 days ago) after the foreclosure and auction the Bank sent a Realestate agent to assess the property and make contact with us. The Agent told us if we leave to call them, but until the 180 days is up they will not ask for eviction.
Now we get a notice from the court that the legal firm who sued for the foreclosure that they are moving for eviction. We told them we were told by the Agent to be out before 180 days but they would not ask us to move before that and we were making plans on that timeline. The attorney came back to us and has told us the most the bank will agree to is 30 days from today with a stipulated agreement. We requested in that case a cash for keys to help assist in us leaving the property in good condition and because the house we had planed on moving to would not be ready till July we would probably have to move twice.
We are to go to court for the first hearing tomorrow morning and we are very concerned that a foreclosure would damage our ability to move and want to enter a stipulated agreement however the attorney and bank have made it as difficult as possible with sending this agent in ahead of time and we are requesting financial assistance to help us leave within the 30 days they have requested. The attorney has said probably not...
Do we have any legal standing to have the eviction dismissed (to only come back again i know) because of what the agent said over the phone to me?
Is there any push back we can give to the attorney to get cash for keys to help with the move? I think that the attorney will not be able to give anything on his own but the bank takes their time in communication knowing that the deadlines will never be put back "playing the game" so to speak. At a minimum the attorney said he is going to add in several stipulations on condition of property and if we violate that stipulation they will seek to evict us even if we are out, that is kind of fighting words and makes me very worried even if we leave the property (it is not perfect) that they may come back after us. Any advice on how to negotiate the terms to protect our departure?
