Hello, It has been almost a year since I had a crash involving my vehicle with a huge drainage ditch. I was totally at fault by attempting to drive after drinking. I was sent by ambulance to the hospital and did not see or talk to a police officer until 5 hours later. He asked me to submit to blood test and I said no. I was badly injured and frankly I was scared out of my mind to submit.

He said my license could be suspended, and I said that was okay with me. I really felt like jumping out of the hopital window at the time, but kept those thoughts concealed because I really wanted to carry it out.

30 days later, I was applying for a loan, and checked everyday to see if my license was suspended. It wasn't. I bought a new car, and then the suspension came up. I hired an attorney, and he got the suspension completely lifted within 7 days.

9 months later I receive a letter from the DA(s) office stating they want to get my records from the hospital. I told my attorney and went to get a copy of them myself. The police didn't take the blood test, but the hospital did when I came in with broken bones, fractured skull, covered in blood, dirt and sweat.

Anyway, it's been 2 months since and I haven't heard or read a thing concerning my case. I called my attorney and he said something like, "he is yet to see a medical blood test stick, because of the type of test they do". He also said the have up to 3 years to charge me? But he said they might not charge me. Has anyone ever heard of this?

I do not drink at all anymore and haven't since that time. I cannot change the past or all the things that led up to my near death experience. I'm just trying to be prepared. The accident did change my life and thought process. I realize I was lucky it even happened because I didn't kill someone with my car that night.

I do talk to people concerning this accident because perhaps by my talking about it, it might help another person. I'm not sure.

I just don't really understand the amount of time that has gone by, and still no charges? Does anyone have any idea the way this process works? I watch the news, and people like Paris Hilton and Mel Gibson have been charged and whatever. I don't know what to do.

I have never heard of this before. Why would they wait so long? I'm not a legal type, but did believe that a person is intitled defend themselves within a certain time frame? 3 years seems like a long long time if they were concerned about someone drinking and driving? Do you think they are perhaps waiting for the person to get into an addition situation?

I don't know why people do stuff. I tried guessing one time but I was always wrong so I gave it up.

I appreciate your taking the time to respond. They said that "as adults", people are repeating cycles of disfunction that take new shapes and forms. I'm addressing myself as the "as adults" & "people", not the courts.

I forgot to add I am now having dreams about driving drunk and getting stopped again. They keep repeating and coming back. It is so wonderful that I wake up and realize it's something that I will never do again. I'm not sure though, why it is visiting my thoughts as I sleep.

I used to have dreams about it, similar to yours. If the experience gets that deeply into your psyche, you're not likely to ever forget it or repeat it. The dreams did finally go away for me though.

You did? They are so real and vivid, I wake up sweating and shaking. I am sure never to forget or do it again. Drinking has been a thing of the past for me, and I can only say that I am doing everything in my power to not pick up that first drink each and everyday. I never again want to be part of the problem, it's an awful waste of time.
