Never received W-2's or 1099's

Was hired to do computer support for a small company. When negotiating pay, employer said I'd be a regular employee rather than a contractor so I agreed to much lower hourly pay. I was paid every 2 weeks with the employees but was always cut a business check for the full pay with no stub, no deductions, no statement of hours, etc.

I never received any W-2's or 1099's and have not filed in a few years because I didn't know what to do! I made approximately $1000 the first year and considerably less the next 2 years.

Regarding contractor or regular employee, besides the negotiation of pay, at first I was to come out on a weekly basis to keep things going smoothly, but it turned into them calling me as they needed fires put out. I always used their tools to do the work and always on site.

And this is the first time you're questioning this?

You need a tax attorney, pronto. You have to claim all your income (unless there is an exclusion under the regulations) whether you received a tax form or not.

Does anyone know if there is a lower limit where an employer does not have to provide a W-2 or 1099? If they pay the employee, let's say, less than $600 over the course of the year do they not have to furnish one?

My income is so low that besides one year, I did not have to file but it may be beneficial for me to file.

1099-MISC does not have to be issued unless the amount is $600 or more paid in the calendar year; however that does not mean you needn't declare the income if you had enough income to require that you file a return.

W-2s must be issued to employees no matter what the amount.
