What is the name of your state? NJ

When a person is charged with DUI in a state other than where they live, which state's laws apply in terms of duration of penalties and so on?.

Here are two examples: In NJ, the first suspension term is 7 months, in other states as low as three. If your DUI occurs in one of those states, how long would a person lose their NJ priviliges for?

Example #2: NJ does not offer a restricted license, but many other states do. Does that mean you can apply to the state where the offense took place for a restricted license that would also be valid in NJ?

Just trying to pin down how these things work! Thanks for your help and whatever time you must devote to providing accurate answers to these questions.

I'm sorry, but why? These are different questions, not previously asked, and besides I have gotten hardly any feedback on the earlier questions that I've posed. I thought keeping these separate would be easier for someone to digest/interpret/respond. I didn't realize I was being censored.

Both states have laws that might apply. If your driving status is suspended/revoked in the state where the crime occurs, your home state may also honor that suspension pursuant to their own laws.

Example #2: NJ does not offer a restricted license, but many other states do. Does that mean you can apply to the state where the offense took place for a restricted license that would also be valid in NJ?
No matter what state your license was issued in, if you were suspended in NJ because of the DUI, you are suspended in NJ. Period.

That is certainly not censorship!

CdwJava - Thank you for your reply. I am aware that the suspension will be applicable in NJ, but I was asking if NJ would follow the other states' protocol, or vice versa, especially in terms of obtaining a restricted license from another state. To be brief - I wanted to know if you lose your license for 3 months in the state where the incident occurred, do you also lose if for 3 months in NJ, or for 7 months which is NJ's minimum suspension. That is a big difference.

seniorjudge - Last I checked, this was a free country and I have a right to post my questions any way I choose. In fact, there's a little box right down at the bottom that says "you may post new threads". So back off, okay? If you cannot respond with something useful, please don't respond at all. I'm sure your time will be much better spent providing people who need help with meaningful advice - and NOT worrying about whether the 'rules' as you perceive them are being violated.
