What is the name of your state? NY
I have been divorced for approximately 6 years and have been paying child support for two children. Recently one of my sons decided to come and live with me. He's 18 and attends college. A lawyer recommended that I contact my ex-wife and legally modify my support so that I am paying for one child and that she would have to pay support for my son that came to live with me.
I've always "lost" every "battle" with her and she did not like this idea. She is stalling me and tried to tell me he is emancipated. He meets no criteria for being emancipated in NY.
I was told by family court that I can modify my support and that I can submit a request for obtaining support from my ex-wife. They sent me the forms and I completed them. To make things work the best, I asked the attorney to file them.
My son that now lives with me is very responsible, works a part time job, and goes to school. I like to help him as much as I can with extras beyond normal stuff and I believe that I'm entitled to support.
Since my ex-wife is such a pain, can someone tell me if I am granted support for my son if I am entitled to back support since he has lived with me (2 months so far)? If so, I will also ask for the modified portion that I have been paying to.
