Nightclub assault in NJ

What is the name of your state (only U.S. law)? NJ

I was punched in the face by another customer at a nightclub. The nightclub did not take down his information and let him run away out the door.

Police were called and they did nothing. There are cameras all over the nightclub, but they have told me multiple times there was no photo or video evidence of the individual. Even though, there are several cameras right by the door he was let out.

The bouncer at the nightclub was in my girlfriends face outside of the club and was psychically pushing and shoving her. The nightclub and police have not handled the situation adequately at all.

What can I do?

If the police do not have an identified suspect, there is little they can do. And without the identity of the person who assaulted you, there is little you can do.

What were your injuries? Did you go to the hospital after the assault?

What are you looking for or expecting here?

Even if they have an identified suspect, you can't force them to prosecute. Criminal matters are the state versus the defendant, not the victim versus the defendant. You have no right to prosecution.

A prosecution can't be forced but the identity of the one who assaulted mc202 makes a civil action possible.

The others have given you accurate advice. About the only other thing that you can do is make a complaint to the owner of the nightclub. It won't necessarily to anything for you, but it might get the bouncer a little re-educated/trained.

I really do understand how you feel. Many years ago my brother was in a bar and was carrying a pitcher of beer back to his table when suddenly a fight broker out behind him and he got shoved and his beer spilled. He was totally an innocent bystander but the bouncer beat him so badly that he ended up in the emergency room. The bouncers didn't care who was an innocent bystander and who was part of the problem.

The bar went out of business not too long after that due to the bad PR.

A major difference between your personal tale and the story told here by mc202 is that the bouncer did not assault mc202. The bar (probably) cannot be held liable for an assault committed by an unidentified bar patron who fled the bar after the assault.

Facts matter but it appears that mc202 has to wait for the one who assaulted him to be identified. The bar does not appear to hold any responsibility, based strictly on what has been said so far. Additional facts might change that.

A civil action is possible if he really has any damages. He'd be on his own to do the digging to find out the identity of the attacker. Even if there was a video camera pointed right at the guy's face, that doesn't mean you know who it is.

The point I was making was that his odds of getting compensation for the situation are not necessarily strong, but the odds of a complaint resulting in better treatment of future patrons might be better.
