I took out a home equity loan with my husband as co-signer and paid off some my husband's business debts (about $65,000) plus paid in full the only credit card my husband and I share ($20,000), in December 06. One week later I saw a letter from the bankl addressed to my husband only, stating he had requested to have my name removed from the credit card account. There was a form enclosed that both of us were to sign agreeing to having me removed from the account. I had not been informed about this. My husband never gave me the form to sign. A few days later I got a phone call from the bank asking for information about a fraud my husband reported. It was actually a transaction I had made and I thought it was cleared up.
This week I opened another letter from the same bank. Included was a new card in my husband's name (none in my name) stating this was the new card and account number for our credit card which my husband had reported as stolen. Enclosed was the one card he had requested in his name only. The account, however, was still in both of our names.
I tried talking to the credit card people and they were very rude because I do not have the new account number, my husband has it. I did give them the old account number and was told only that that account had been closed due to fraud and the would not give me any other information or help.
In Calif, as a community property state, does it make a difference if my name is on the account? I have no access to it, I can't use it and my husband has already gone over the limit by $10,000. I do not want to be responsible for his debt. Should I call the bank again and have my name removed from the card? They refuse to talk to me about it since I don't have the account numbers.
Am I responsible regardless if my name is on the account or not?
He has 5-6 other credit cards in his name only, most of them over the limit, that he uses for his business. Am I responsible for those cards too? I have no credit cards in my name or any joint accounts with my husband.
