The last 5 years I have rented a house located on the upper portion of a parcel that also has 2 other buildings providing 5 other rental units. We share a common driveway from the street which ends at the parking lot for those units. The entry to my unit is a steep, rutted, dirt driveway with no outlet branching off the common driveway.
I never felt comfortable, and now finally know the illegality of my landlords practice of personally collecting the monthly rent from a mailbox mounted on the wall by my front door. When I entered the rental agreement it was described that my unit included the land above the lower units.
The worse part of this monthly invasion of privacy was her refusal to keep her unleashed dog away from my home which I share with two kitties (included in rental agreement).
Last Saturday, I was away part of the day. I returned to find my cat, Furgie, noticeably in pain. Throughout the evening her condition worsened. It took a specialist veterinarian to establish the cause for her internal injuries and trauma. After shaving her to prepare for an ultrasound, the site of impact was located and was congruent with the diagnosis of my kitty being grabbed and violently shaken by a dog.
The landlord and her unleashed dog were at the lower units that day. I fenced to keep dogs out from other access points years ago. Her dog was the only dog on the property that day.
Besides putting an end to the monthly intrusions, and fencing out her dog, do I have any right to claim for damages incurred? It was not rent day, I was not aware of her intention of being on the lower property.
I really appreciate your reading this and helping me.

Having the animal treated and inspected by a licensed vet is good evidence, but two or more exams by different vets to corroborate the initial diagnosis is better...

anyway, to the person who started this thread:
where was your cat when the dog attacked her/him? i dont know from you post but i am guessing your cat is an indoor/outdoor type wandering cat...which if it's the case, i m sorry to say but it will be impossible to prove where your cat was when she was hurt. if you can prove that the cat was on your property when the dog attacked it, then you might have a case.

i m sorry for you cat...that's pretty awful. if it comes down to you being unable to prove where the attack occured, perhaps check for leash laws in your city and file a complaint on the owner's wandering dog each and every time you see it without a leash.

OK, if you read the post, dontbesojumpy, there is no way for OP to prove that it was LL's dog that hurt her cat; intead of say:
1. A fox
2. A wolf
3. Another dog roaming the neighborhood

You are ABSOLUTELY wrong.

And how does OP prove that cat was on her rental property when "something" attacked it???

BTW, the dog doesn't rent any property, so he/she would not have a "lease".
The dog should have a leash , though...

i could ASSUME anything from the post, but i cannot TELL where her cat was or where the dog was. that's why i asked. what's the big problem? you said what i already said, except i was ASKING instead of just pretending i already knew. what am i wrong about? being able to prove if was that dog if the cat was wandering around? i said the EXACT SAME THING YOU SAID. if you are going to try to attack me at least wait until you can make sense.

From your post, I assume the cat was outside the home. It is always a good idea to keep pets inside the house (safe environment) when you are not there to watch them.

There is no way to determine where the cat was when he was attacked or what animal attacked him.


Why can you not mail or hand deliver the rent payment each month.

How would she know where the cat or dog was if she did not see what happened to the cat?

Your type of help is not needed here. Your thread was closed because of your behaviors that violate the TOS. It will be a lot easier on you if you leave an go away, quit stalking and attacking other members.
