We bought this house on Feb 16th. On the seller's disclosure there was no word about water in the basement, though after it was noticed in the home inspection that there was some staining on the carpet (probably due to water in the basement), the previous owners told us (not in writing) that the bilko (walk-out door) leaked once.

Well last weekend (5 weeks after purchase), we had about 1.5 inches of water in about 80% of our basement. (see pictures). After I was working all Sunday to get the water out, we called a professional to dry the (finished) basement out. they arrived on Monday when they removed the baseboards at the bottom of the walls, there was dry mold all over the inside of most of the baseboards. The contractor (National chain) said that the only way for that much mould to be behind so much of the baseboard is that there was flooding in the basement ( of probably more water then what we had) before.

Looks like to get this fixed there will have to be a sump pump installed which will be in the range of $5-8K. I have pictures of the water that was there last week. I have pictures of the mould on the baseboards.

Since the mold existed before we moved in (it was dry while the rest of the basement was wet), and there is no way that they did NOT know the flooding happened, is there a case for going back to them for misrepresentation on the sale of the house and get them to pay for the proper repairs? What of the for work that I had to do?
