What is the name of your state (only U.S. law)? Georgia

This forum has been helpful in helping me but I have another question. I was stopped and a pickup truck backed into me. The police concluded the driver was at fault but he was not cited because we were on private property (wells fargo parking lot).

Now the insurance company, Cornerstone National, has accepted liability. They claim they are sending me a check for damaged and rental car. I am assistant to a real estate broker and was on my way to a property when the accident occurred. The impact caused my work computer to be damaged. The driver of the other car agreed to pay for it on the Monday after the accident when I spoke to him.

Since then he has stopped answering phone calls. Do I have to sue him or notify the insurance company?
