What is the name of your state? Washington, Pierce county

We had a 2-year lease that was extended for 1 more year until Apr. 2008. Payments were always on-time and if they were a couple days late, tenant would call and explain before due date so we never charged any late fees and believed her. She called sep. 5th and asked to pay half of the rent on 15th, and another on 30th because of job complications. She also said that she would add a late fee of $150. We agreed but on 15th was a letter from her asking to pay the whole sum for 2 months on Sept. 30th. We agreed again. On Sept. 30th she said she can't pay now but she'll pay for both months and a late fee of $150 as soon as she can. She also said that she cannot afford this house any longer and will be moving out by the end of October. We came and talked to her and told her that if she pays by Oct 15th, we'll even forgive the late fees and if not, then she'll have to move out asap and we'll add the late fees as it says in contract $25 per day late and sue her. She agreed but on Oct. 15th she sent letter saying she can't pay and nothing about if she'll ever plan to pay anything and that she is planning to move out on Oct. 28th. We gave her a "3 day notice to pay or move out" on Oct. 15th and filed with a county court an eviction notice. Also I went to small claims court and served her papers for the whole amount owed.

My question is can I still sue her if she moves to another county. Another question is the person on the lease is her ex-boyfriend and she said she was his agent and the only place her name on contract is the person who is allowed to live there. In sept. she said that he moved to Arizona some time ago. Can I sue him if she doesn't pay anything. I had a small claim court order in my favor some time ago with another person who damaged my car and got nothing with collection agency because she didn't have anything.

Yes, you can sue the people on the lease. How will you collect? Good question. Large creditors have a difficult time collecting.
