What is the name of your state (only U.S. law)? Texas. I was suspended from work wrongfully. I was supposed to get a write up for not calling in on the first time. The supervisor wrote me up and suspended me the same day. On my way home I was in a terrible car accident which has left me with 3 disk herniation, 2 pinched nerves ,and 2 disk dislocations. Before I was suspended , while being at work I was supervising. There was an employee there working for me which was allowed to come back to work on light duty. I feel my equal rights were violated, also I feel discriminated because I am Hispanic and the other employee was a white person.

My Dr released me for light duty, when I went to go to work my company said they didn't have any light duty work for me, but they had light duty work for the other employee. After my MRI results came back my Dr.has kept me from returning to work.

I guess you were lucky that the employer wasn't able to accommodate you with light duty, huh? Also, at this time, you won't qualify for unemployment since your doctor has kept you from returning to work.

There are many legal reasons why one employee might be given light duty and another not. There is only so much light duty to go around at any given time and if there doesn't happen to be any available that is within the employee's restrictions, the employer has no legal obligation to make some up regardless of what light duty might have been available for another employee.
