I reside in Oakland, California. Our marriage dissolution settlement (1991) stated that spousal support payment was to be paid "on or before the first day of each month". He was on time the first year or so. Then payments would be received between 5-10th of each month for about 4 years. Then last year (late 2000), he was transferred out of the country (to Norway)for 2 years. He arranged with his bank in Hawaii to make the payment to arrive on the 15th without my knowledge. I let it slide. However, the payment for Feb has not been received (as of 2/23)and when I contacted him questioning the delinquency, he would not reply to me.

My question: Could I go to my county clerk and file with the county to notify my ex that he comply to our settlement agreement (i.e. to make the payments on or before 1st of each month) and he could not change payment day without my signed agreement. Or do I need an attorney to file it for me? "In the event Husband is ever delinquent in his sousal support payments to wife, wife will be able to collect any and all delinquent sum from husband through any remedy available to her." What is the remedy availableto me? What recourse do I have?
