What is the name of your state (only U.S. law)? I live in RI, but was working in MA

I started working for a large corporation on 6/24/08. I was hired as a waitress at $8.00/hr. Then I was offered a position in the office as an office admin. - same pay rate - but i took it to pick up more hours, and was also told when our new location opened, I would recieve a raise.

The last week in July, a girl came in for an interview and was not hired by the hiring manager. The directing manager, for some reason, had me locate this girls' application/hiring worksheet and have her come in for an office interview, which she did and was hired as an office admin. for $10.00/hr. (Much less experience and less significant work experience than me)

When I approached the managing director about this I was told not to worry, as soon as our new location opened he would 'take care of me'. At this time I had applied for management(with the managing director's encouragement) and didn't want to 'rock the boat'.

At this time we had another office admin., who had been there about 4 weeks before me, who was hired at the rate of $9.00/hr.(He left about 2 weeks before I did)

On 9/16/08 I resigned from my position because I was still listed as a waitress making $8.00/hr when in fact I was in the office 3 days a week literally busting my ass. I had 1 shift waitressing a week.

My co-worker would listen to music on her i-pod station, pop prescription pills, go out with all the employees (at this time she had slept with two of the employees, and the managing director was aware of this) and when the managing director was not in, she would do absolutely no work. She would read books. I can confidenty say I did 50% more work than she in the 3 days I was there a week. I left at 8.00/hr, co-worker was still making 10.00.

I should mention that I had approached the MD several times about my payrate and was told that a raise request had been put through to $10.00/hr. I asked for $11.00 and was told the most he can give an office admin. was $10.00. I asked him if he could make me a cook supervisor, at the rate of $13.00/hr and was told no.

Fast Forward:

My former co-worker and former managing director have been out at least once, and he was 'flirting with her hard core' and 'wants to f*** her'. I have proof of this (esact wording)in the form of a text msg from her, and his texts to her were fwd to me.

She has, as of last week, been given a payraise to $13.00/hr.


I think I have listed all relevant information, please if you have questions just ask.

My question is whether I should see an attorney? I think that maybe I should, but if this is a common occurance in large corporations and I'm just being a 'whiny baby' then I don't want to pay for a consultation to have some one tell me that.

Any comments or suggestions are very appreciated. Thank you.

This is a common (and legal) occurance in large corporations and you are being a whiney baby.

Well, no, not really. I don't blame you for being upset. But it is nonetheless true that due to market compression, it is both common and legal for new hires to come in a wage over that of the existing employees. Additionally, the only time under the law that an employer is required by law to give you an increase is if minimum wage is raised by the appropriate legislative body and your wage is below the new minimum.

It is unfortunate but true that with the exception of the 9th Circuit, and not always there, favoritism towards one employee does not give employees who are not favored any legal recourse.
