What is the name of your state? AZ
I work for a private club. Recently we had a need for a Notary. She charged $25.00. Since I have learned the max. she could charge was @2.00 plus mileage.
She advertised in our bimonthly news magazine.
My question is now that we know she is illegally charging and is subject to a class 5 felony, are we in jeporady by allowing her to advertise in our flyer knowing what we do?

As long as fees are reasonable and quoted in advance there should be no problem, $25 for a moble Notery service seems appropriate considering the cost of fuel and time to travel.

Notary Fees

I'm not the one that made that rule. Page 48 of the Arizona Notary handbook says max. fee is $2.00 and travel @ 34.5cents per mile.

You didn't read it all, you forgot the part about per diem as per AZ state schedule, all of which are in excess of $25.

thanks for your help, please tell me where you found that.
I was given a heads up by another notary about this. I am not a notary, therefore I do not know.
The notary that told me about the infraction said she went to a class for this.

I just want to do the right thing. Not cause the notary that came to us in time of need.

I pulled up the pdf file and read the entire [paragraph and then went as directed to the AZ state pages with per diem defined. They have to allow for time and travel otherwise no one would do it.
