I live in Indiana. I had a previous arrangement to pay off a debt with a collection agency of $50.00 a month. Anyway I missed a couple of months because I was short on money and then received a letter stating I had to appear incourt to explain why I hadn't paid. I forgot to appear for that court date and now I have received a letter stating the court has been requested to issue a writ of attachment for my arrest. It states to avoid arrest I must be present at a new date and time in court. I plan to go to this court date but what should I do? Should I bring anything? What should I expect to happen? And why are they being so hard on me? I just missed a couple of payments. I don't think that I deserve an arrest warrant.

Was the warrant for failure to appear?

This has nothing to do with you missing payments. This only shows a pattern of continued irresponsibility.

Don't try the Ohhh I forgot about the court date, I bet you did not think anything would happen when you did not show. I will also warn you, I am not being sarcastic, this is probably what the judge will think of that excuse as well.

Although, was this a criminal matter or a civil matter~the monies due~?

Presumably, this was an FTA warrant (very likely on a court ordered debtor exam, or similar).
Show up at the ordered time and place..... and bring a nice box of chocolates (mixed) for the judge.

Sounds to me like your 'arrangement' was a consent to judgment that they would not enforce as long as you made your payments. You didn't, they exercised their rights to execute the judgment and wanted you in court to explain - you blew it off, now they are forcing you into court to answer their questions about your income and assets. You have a judgment against you, they want their money and they WILL get it from you, one way or the other.

Lesson learned - never, EVER blow-off a court date !!

Dqueen is right - the Judge isn't going to want to hear 'I forgot', they are NOT sympathetic - not unless you were completely incapacitated, on your deathbed in a hospital on the last court date !! Acting the airhead isn't going to cut it in this situation.
