I was just served with a notice of deposition on Mother's Day--my ex is taking me back to court to review child support and to request additional vacation time with the children. We also have a court date and a date for mandatory mediation---My question is: Am I required ie: ORDERED to attend the deposition? I know that I need to attend the mediation and of course our court date. Does a "Notice of Deposition" have the same power as a subpoena? I was not served with a subpoena or a court order.
Also, any idea as to why an attorney might seek a deposition in such a case? In my experience, modification of child support is a fairly straightforward process and doesn't require a lot of discovery, just an Income and Expense Declaration and supporting documents 1099, W-2 etc.....
