Notice to demolish home in 45 days
What is the name of your state (only U.S. law)? Alabama. My mom owns a home that the Mayor wants demolished. The wiring and plumbing is good. The lawn is kept clean and cut. The structure had been checked by a homebuilder and deemed sound. This is the second attempt in several years by the Mayor to demolish the home. She was given a 45 day notice. Each time the Mayor tried this, he has a friend that has a business interest in the property. When my Mom asked for a list of things that needed to be done to the house to keep this from happening the fire chief gave her a strange list that included things like she needed to install ladders from the windows so someone could get out in case of a fire. I'm short and could easily step out of the windows to the ground. The Mayor even went to the water department and told them not to turn the water on at the home. The water had already been on for three months so they couldn't do anything about that. My brother lives there part time. He has a home in a nearby City and his children are in the town where the home is. There are many homes in the area that look worse than here. Hers does need a paint job. Who can we contact to stop the demolition order? A lot of people in the town thinks the Mayor is underhanded. One person says that he was an inmate in the little jail there and was made to work on family members of the mayors homes and yards.

You need a lawyer. Someone who is familiar with real-estate.

THe demolition of blighted properties is popular in some areas...and being less in need of care than neighbors is NOT a good excuse....often, being occupied and making some progress to get it back to Code. Is a good reason not to be on the hit list ...its sort of fair game to use a lot of bully power to get results ....in your case I suggest. MOm NEEDS some paid consult with local attorney who knows the local government ropes but does not owe his or her pocketbook to town **************around me some owners of very blighted properties have used the legal ropes to obfuscate town getting things fixed up or torn down.....but I 'm not in Moms shoes .

WHether the mayor has friends who buy up distressed properties or uses convict labor is NOT a relevant issue to debate in Moms shoes .

Keeping the property occupied and making even nominal progress to improve it may be critical .....

Thank you so much for your quick response and the advise. They have never sent anyone to inspect the home so it may be up to code or close. Our family has two home builders and a licensed contractor so we could make the repairs if they would tell us what repairs it would take to keep it from being demolished. But they won't. We went to a city council meeting to discuss it and the Mayor said that it was a fire hazard because the electrical wiring was bad. (No inspection, just a guess on his part) we told him that his (the mayor's) Uncle rewired the house just a few years ago. We asked him if his uncle did good work and he said of course he does! He got mad and said he didn't want to talk about it anymore and dropped the demolition for a few years.

Again, your Mom needs a lawyer.

Preferably one from somewhere away from your corrupt little town who isn't part of the good ole boy network.
