What is the name of your state? Idaho
On April 11, 2006, I was served a "Motion in Affidavit Form For (1) Order Directing Removal of PERSI Beneficiary and (2) Order of Contempt"". In this order there is no notice of any Court date. I called the Clerk of the Court to find out if I have to be notified by my ex and she said that I should be notified by mail....well, as of today I still have not been notified. The clerk of the Court told me the date which is in 2 weeks. My question is this: Do I legally have to be notified from my ex's attorney and if I am not should I tell the Judge this when I appear? I am representing myself.

Thank you for your help.

Proceedure can vary from state to state, but in my state it wouldn't be the opposing attorney that would notify you of the court date....it would be the court itself that makes that notification.

Yes, I would certainly let the judge know that you were never officially notified of the court date, and how you found out about it.
