What is the name of your state? What is the name of your state?WY
I have custody of my 14 year old son. He is really into to sports and wants to come back early from his Mom's this summer to try out for the A team in football. He has tried calling her and writing her letters explaining why he wants to cut short the visit but she will not work with him.He is also tired of being stuck in her house all summer while she works and he hates being away from his friends here. She can visit him every other weekend during the school year but chooses not to because she lives 6 hours away. She flies him where she lives just for her major holidays she can have with him. He wants to know when I go to visit him this summer during my weekend summer visitation in Aug. if he goes back with me without her consent and cuts his visit three weeks short will we get in trouble? I know how upset this whole thing is making him and he even has said he will just hide when it is time to go see her. What should we do? Can I be arrested if I do it?

you can get in trouble if you do not have the child available for her time

can you possibly trade out that time so your son can still do his sport? like give her a good holiday in exchange for those weeks? or all of x-mas break, something that makes it seem more fair to her?

You likely won't be arrested, but you will more than likely be found in contempt of the court-ordered visitation. That order isn't a suggestion - it's an order. If Mom doesn't exercise all or part of her time - it's her right not to. However, you must make the child available when the court says he's to be available. To do otherwise risks fines, jail time and a change in custody.

You have to allow her her time with your son. If you don't then you could be in contempt. Your best bet is to allow her, her time but if you and the son talk to her maybe she will change her mind. Good Luck :)

Does mom get the entire summer? If not, can't you negotiate for him to both go early and come back early? You also have the option of petitioning the court to shorten mom's visit so that he can try out for the A football team.

If mom has all summer then I don't think she is being fair to your son. However, if she doesn't, then you need to be fair to mom by re-arranging the schedule so that she gets her full time, or almost her full time.
