:confused: I am from NY and this last November 05, seperated from my husband due to spousal abuse. I have recently started seeing someone new, but have not been intimate in any way. Can anyone tell me the laws surrounding seperation in New York State and if I choose to start a relationship with this new man, can it be used against me as in adultry.

Yes it CAN be used against you to secure the divorce but that has a very slim chance of affecting the property settlement.

If you both want the divorce, what would be the point of him raising the adultrey issue?
