NYC Co-op and Removing ex's name from Stock Certificate

What is the name of your state? NY


Hi Everyone,

I've been trying to remove my ex-husband from my stock certificate and my mortgage. During the divorce he signed over a Marital Property and seperation agreement in which he gave me the apartment, and it is also listed in the final divorce papers.

I have been working on refinancing the mortgage and the stock certificate was to be changed. We (my attorney and I) just heard word from his attorney that he is no where to be found.

We are trying to locate him and get him to the closing so he can sign over the stock and lease but we cannot find him.

What happens if we can never find him? What happens to my property? While it is written on the divorce papers, the banks don't know that he is no longer entitled to the property so he can use the equity on the property, i think? or i may be getting ahead of myself.

i guess the question is.....is there any way to get his name off the property now that he is missing?

**A: yes and your attorney should already know the steps.

Is there somewhere where I may be able to look it up as well?

I'd just like to be prepared so I can ask informed questions.

Unfortunately I don't have a ton of money to spend on my attorney asking him to explain everything to me, so I'd like to know a bit before I go in.

**A: if you had a deed, your attorney would file court papers titled an action to quiet title. But since the method of ownership is the stock, the action would be to quiet stock or settle ownership of the stock in the coop.
This is explained in very simplistic terms. There is a lot more to it but that's a start for you.
