NYC Eviction Process

I am trying to help my grandmother evict a tenant, but we are unsure of the process. Her apartment building is in the Bronx(we live in CT), and the tenant has been there for 8 years - he signed a lease for the first year and has not had one since. He is 5 months behind in rent and his phone has been disconnected. According to the other tenants, 2 big men came looking for him about 2 weeks ago and told him he owes money and better pay up - since then no one has seen him. He has changed the locks, and no longer employed by the company my grandmother had a record of - we do not know if he is dead or alive. One of the neighbors said that occassionally his mother brings the kids in the morning to wait in front of the building for the bus. What recourse does she have? and does anyone know the process of eviction.

Is there a funny smell coming from the apartment?

Seriously...YOU need to get your butt to the bronx TODAY, bring some clothes and stay a awhile with your grandmother.

You nned to hire a landlord tenant lawyer to start the eviction process, because YOU CANNOT do this yourself. Abandoned property is the tenants, and must be accounted for.

When a judge agrees its abandoned you can sell it to help pay back rent.

Also you must get the mother of the tenants kids,to agree with you and to get the police and open the apartment, an see if he is dead or is everything gone? It is ILLEGAL for the tenant to change the locks.

With apartments so scarce in New York City waiting this long is just plain STUPID

So what are you waiting for?..........


Also there is a stale rent law if the landlord doesnt ask for rent for 3 months they lose it...

Plus its takes longer to evict a tenant if your gandmother wants money......if she just wants posession so she can re rent that could be done this month....

So why are you still in CT? she is losing money everyday you are there.
